Welcome to Paint Tigers. These Terms and Conditions ("Terms") govern your use of our website, your engagement with our painting services, and any agreement you enter into with Paint Tigers ("Paint Tigers," "we," "us," or "our"). By requesting an estimate, booking a service, or using this website, you agree to these Terms in full.

If you do not agree with any part of these Terms, do not use our services or this website.

1. About Paint Tigers

Paint Tigers is a residential and commercial painting company operated by PAINT TIGERS LLC, serving Plano, Texas and the surrounding Dallas–Fort Worth metro area. Our principal place of business is 1404 Linden Dr, Plano, TX 75075.

2. Services

We provide interior and exterior painting, surface preparation, minor carpentry repairs incidental to painting, and related services as described in your written estimate or scope of work. Services not listed in your written estimate are not included unless added in writing through a signed change order.

3. Estimates and Quotes

Estimates are based on the information you provide, our on-site or virtual assessment, and current material pricing. Estimates are valid for thirty (30) days from the date issued unless stated otherwise. Pricing may change after that period due to material costs, scope changes, or site conditions discovered during prep.

An estimate is not a binding contract until both parties sign a written agreement or you accept the estimate in writing (including electronic acceptance).

4. Booking, Deposits, and Payment

  • A deposit may be required to secure your project date. Deposit amount and timing will be set out in your written agreement.
  • Progress payments may be required on larger projects, as outlined in your agreement.
  • Final payment is due upon substantial completion of the work and your walk-through approval.
  • We accept payment by Venmo, Zelle, PayPal, cash, check, and direct bank transfer.
  • Past-due balances accrue interest at the lesser of 1.5% per month or the maximum rate allowed under Texas law.

5. Cancellation and Rescheduling

You may cancel or reschedule your project under the following conditions:

  • Cancellations made more than seven (7) days before the scheduled start date: deposit refundable, less any non-recoverable material or permit costs already incurred.
  • Cancellations made within seven (7) days of the scheduled start: deposit is non-refundable.
  • Rescheduling is subject to crew availability. We will make reasonable efforts to accommodate new dates.
  • If we cancel or reschedule due to weather, illness, or other operational reasons, your deposit remains credited toward your project with no penalty.

6. Scheduling and Site Access

You agree to provide safe and timely access to the work area during agreed working hours. Delays caused by lack of access, unprepared work areas, or other client-side issues may result in rescheduling fees or extended timelines. We are not responsible for delays caused by factors outside our reasonable control.

7. Customer Responsibilities

Before work begins, you agree to:

  • Remove or relocate fragile items, valuables, electronics, and personal belongings from work areas.
  • Disclose any known issues with the surfaces to be painted, including lead paint, mold, water damage, or structural concerns.
  • Secure pets and ensure children are kept clear of work areas during active painting and drying periods.
  • Provide reasonable access to water and power as needed for the project.

8. Color, Sheen, and Material Selection

Final color, sheen, and product selections must be confirmed in writing before the work begins. Color appearance can vary based on lighting, surface texture, and substrate. We are not responsible for dissatisfaction with a color or sheen that was approved by you in writing.

If you request a color change after work has started, you will be responsible for additional labor and material costs through a signed change order.

9. Change Orders

Any modifications to the original scope, materials, or finishes must be documented through a written change order signed by both parties before the additional work begins. Verbal agreements are not binding.

10. Surface Preparation and Pre-Existing Conditions

We perform surface preparation as described in your scope of work. We are not responsible for:

  • Pre-existing damage, defects, or substrate issues not disclosed before work began.
  • Failures caused by underlying conditions such as moisture intrusion, structural movement, or improper prior coatings.
  • Cracks, nail pops, or settlement that occur after the work is completed due to normal house movement.

11. Weather Delays

Exterior work is weather-dependent. Rain, extreme heat, cold, humidity, and high winds can delay or pause work. We will reschedule weather-impacted work as soon as conditions allow. Weather delays are not grounds for cancellation or refund.

12. Warranties

Paint Tigers offers three warranty tiers. The applicable tier will be specified in your written agreement:

  • 1-Year Warranty: Covers workmanship defects for twelve (12) months from the date of project completion.
  • 3-Year Warranty: Covers workmanship defects for thirty-six (36) months from the date of project completion.
  • 7-Year Warranty: Covers workmanship defects for eighty-four (84) months from the date of project completion.

Warranty coverage applies only to the workmanship performed by Paint Tigers and does not cover:

  • Damage from acts of God, fire, flood, storm, hail, or other casualty events.
  • Failures caused by substrate issues, moisture intrusion, structural movement, or pre-existing conditions.
  • Normal wear and tear, fading, chalking, or color drift over time.
  • Damage from third parties, pets, abrasive cleaners, pressure washing, or improper maintenance.
  • Surfaces not covered in the original scope of work.

Warranty claims must be submitted in writing to ron@painttigers.com. We will inspect the claim and, if covered, repair the affected area at no charge. Warranty is non-transferable unless stated otherwise in your written agreement.

13. $25,000 Quality Guarantee

Paint Tigers stands behind every project with a $25,000 Quality Guarantee. If we fail to deliver on the workmanship standards expressly described in your written agreement, and the failure is not remedied through our standard warranty process, you may be eligible for compensation up to twenty-five thousand US dollars ($25,000) under the terms described in your signed agreement.

The $25,000 Guarantee:

  • Applies only to projects completed by Paint Tigers under a signed agreement that references this Guarantee.
  • Is subject to the specific conditions, exclusions, and claim process set out in your signed agreement.
  • Does not cover damages outside our direct control, including those listed under Section 12 exclusions.
  • Requires written notice and a reasonable opportunity for Paint Tigers to inspect and cure before any payout is considered.
  • Is the sole and exclusive remedy under the Guarantee program. Total liability under the Guarantee is capped at $25,000 per project.

14. Property Protection and Damage

We take reasonable care to protect your property during the work. We will cover floors, furniture, fixtures, and landscaping as appropriate to the project. If we cause damage through our negligence, we will repair or replace the affected item at our discretion.

We are not liable for:

  • Damage to items not disclosed or items left in the work area against our recommendation.
  • Hairline cracks or minor imperfections that become visible after painting due to lighting or fresh paint contrast.
  • Damage caused by your acts, third parties, or events outside our reasonable control.

15. Insurance

Paint Tigers maintains general liability insurance and workers' compensation coverage as required by Texas law. Proof of coverage is available upon request.

16. Hazardous Materials

If lead paint, asbestos, mold, or other hazardous materials are discovered during the project, work will be paused. Remediation is not included in our standard scope and must be addressed by a licensed specialist before painting resumes. Costs and timeline impacts will be addressed through a written change order.

17. Photos and Marketing Use

Paint Tigers may take before, during, and after photos of completed projects for marketing, portfolio, and training purposes. We will not include personally identifying information (such as your name, address, or photos of you) without your written consent. If you prefer not to have your project photographed, notify us in writing before work begins.

18. Limitation of Liability

To the maximum extent permitted by Texas law, Paint Tigers' total liability under any agreement is limited to the amount you paid for the specific project giving rise to the claim, except where the $25,000 Quality Guarantee applies under Section 13.

In no event will Paint Tigers be liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of income, or emotional distress.

19. Indemnification

You agree to indemnify and hold harmless Paint Tigers, its owners, employees, and subcontractors from any third-party claims, losses, or expenses arising out of your acts or omissions, your breach of these Terms, or your failure to disclose known property conditions.

20. Subcontractors

Paint Tigers may engage qualified subcontractors to perform portions of the work. All subcontractors are required to meet our quality and insurance standards. Paint Tigers remains responsible for the overall quality of the project.

21. Dispute Resolution

Before initiating any legal action, you agree to first contact Paint Tigers in writing and allow thirty (30) days for us to investigate and propose a resolution.

If the dispute cannot be resolved informally, both parties agree to submit the dispute to binding arbitration in Collin County, Texas, administered under the rules of the American Arbitration Association. Each party will bear its own attorney fees unless the arbitrator awards otherwise.

Nothing in this section prevents either party from seeking equitable relief in a court of competent jurisdiction for protection of intellectual property or to enforce an arbitration award.

22. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Venue for any permitted court action is Collin County, Texas.

23. Website Use

The Paint Tigers website is provided for informational and lead generation purposes. By using the site, you agree:

  • Not to use the site for unlawful or harmful purposes.
  • Not to attempt to access non-public areas of the site or interfere with its operation.
  • That all content on the site, including text, logos, images, and trademarks, is the property of Paint Tigers or its licensors and is protected by US copyright and trademark law.
  • That submissions through quiz funnels, contact forms, or other website tools may be stored and used to follow up on your inquiry and improve our services, in accordance with our Privacy Policy.

24. Communications and Consent

By submitting your phone number or email address through any Paint Tigers form, you consent to receive communications from Paint Tigers regarding your inquiry, project, and related services. Standard message and data rates may apply. You can opt out of marketing communications at any time by replying STOP to text messages or using the unsubscribe link in emails.

25. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

26. Entire Agreement

These Terms, together with your signed project agreement, written estimate, and any executed change orders, constitute the entire agreement between you and Paint Tigers regarding your project and supersede any prior verbal or written agreements.

27. Changes to These Terms

Paint Tigers may update these Terms from time to time. The latest version will be posted on our website with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
